The general conditions of sale described below detail the rights and obligations of the Bears and Birds company to which the Histoire d'Âm'Ours brand belongs and of its client in the context of the sale of the following goods: stuffed animals, parts unique not intended for children.

Any service performed by the company Bears and Birds therefore implies the buyer's unreserved acceptance of these general conditions of sale.


Price

The prices of the goods sold are those in effect on the day the order is taken. They are denominated in euros and calculated exclusive of tax.

The sole proprietorship Bears and Birds is not subject to VAT (VAT not applicable - article 293 B of the CGI) as a result, the prices will be increased by the transport costs applicable on the day of the order.

The Bears and Birds company grants itself the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the prices indicated when the order is registered.


Discounts and rebates

The proposed prices include the discounts and rebates that the company Bears and Birds would be required to grant given its results or the assumption by the buyer of certain services.


Payment terms

Orders are paid for:

• or by bank card;

• or by Paypal.

Items purchased will be shipped upon receipt of payment.


Delivery

Delivery is made:

• or by the direct delivery of the goods to the buyer;

• or at the place indicated by the buyer on the order form.

The delivery time indicated during the registration of the order is given only as an indication and is in no way guaranteed.

Consequently, any reasonable delay in the delivery of the products cannot give rise to the buyer's benefit to:

• The allocation of damages;

• the cancellation of the order.

The risk of transport is borne in full by the buyer.

In the event of missing or damaged goods during transport, the buyer must make all the necessary reservations on the order form upon receipt of said goods. These reservations must also be confirmed in writing within five days of delivery, by registered post.


Right to retract

In accordance with the provisions of Article L. 121-21 of the Consumer Code, the customer has a period of fourteen (14) clear days, from the receipt of the Creation (s) delivered. , to exercise your right of withdrawal without having to justify your decision, nor to pay penalties. When the period of fourteen (14) clear days expires on a Saturday, Sunday or a public holiday, it is extended until the next working day.

To exercise the right of withdrawal, the customer must notify Sylvie Noailles, by email to the following address at sylvie.noailles@histoiredamours.com and / or by registered letter with acknowledgment of receipt to Histoire d'Âm'Ours, 15 route de Noyen, Hameau de Ouinotte, 77480 Grisy-sur-Seine, France, its decision to withdraw by means of an unambiguous declaration, expressing its desire to withdraw, indicating in particular its identity, its delivery address and billing (if they are different), the subject of the order, the date of receipt of the Order.

The customer, without delay, and at the latest, within fourteen (14) days from the communication of his decision to withdraw, returns the Creation (s) concerned complete (s) in his (their) ) packaging and its (their) original packaging in good condition, neither opened nor altered, to the postal address of the Histoire d'Âm'Ours brand.

If the aforementioned conditions are met, the customer will be reimbursed, within a maximum period of fourteen (14) days from the receipt by Bears and Birds of the Creation (s).

If a Creation reaches Bears and Birds damaged or in a condition that does not allow its resale or in a depreciated condition or in a condition that does not allow the customer to exercise the right of withdrawal, Histoire d'Âm'Ours may refuse the return. of Creation and, under these conditions, refuse to refund it.

Histoire d'Âm'Ours will not be required to reimburse the additional costs of returning the Creation (s) if the customer has expressly chosen a more expensive return method than the initial delivery method offered at the time of the Order and within the framework of these T & Cs.

The refund will be made via the means of payment used by the End Customer when placing the returned Order.


Legal guarantees

The Artisan of Art undertakes to comply with the legal provisions in force, provided for in the Consumer Code and the Civil Code, expressly referred to in Appendix 1 of these T & Cs.


Force majeure

The responsibility of the company Bears and Birds cannot be implemented if the non-performance or the delay in the performance of one of its obligations described in these general conditions of sale results from a case of force majeure. . As such, force majeure means any external, unforeseeable and irresistible event within the meaning of article 1148 of the Civil Code.


Court of competent jurisdiction

Any dispute relating to the interpretation and execution of these general conditions of sale is subject to French law.

In the absence of an amicable resolution, the dispute will be brought before the Commercial Court of Melun.
